Definition

youneaty	The set of servers, websites and services that are accessible under the domain youneaty.com, youneaty.de and its sub and co domains. In the following document also called platform.
User	Users who use the platform - whether registered or not.

Operator

§ youneaty is operated by Thorsten Schleinzer, Fichtestrasse 11, 63150 Heusenstamm, GERMANY - hereinafter "Operator".

General Conditions

§ youneaty is an internet platform for arranging contacts between people on a voluntary and non-binding basis. In this case, registered users can set their own profiles and exchange messages, unless they violate the law or Terms of Use.

Use

§ youneaty can only be used by persons with legal capacities, unrestricted and normal persons over 18 Years of age (not a judicial person).

§ A right to use youneaty does not exist.

§ Users are required to use youneaty properly, not illegally or in an abusive manner.

§ youneaty may not be used in a way that harms their networks or servers, puts it out of service, overburdens or impairs and interferes with the use and practical value of youneaty by or for a third party.

§ To use youneaty you must be in acceptance of "cookies" from the platform and have "JavaScript" enabled in your browser.

Registration and User Accounts

§ Active participation requires registration. By registering you agree to these terms and conditions.

§ The chosen username must not be misleading, be abusive or otherwise objectionable or illegal. The operator has the right to change a user name at any time or at its discretion.

§ The users agree that all information given is principally for publication on the Internet, open to the public and declassified.

Profiles

§ The users are obliged to provide truthful information in their profiles when created.

§ The profiles must not have any offensive, lewd, pornographic or otherwise illegal content, this also applies to any provided pictures.

§ Messages between users are solely personal and are not to be used for advertising or other non-appropriate content abuse.

§ The privacy of other users is considered. It is prohibited to save and print the profiles, messages, photos or any other data of other users either for personal or third party use.

§ The operator reserves the right to block or delete users, at its discretion or at any given time.

Granting of Rights of Use

§ Users grant the operator unrestricted and gratuitous rights of use on all submitted data, that is not strictly personal, persisting even over a potential deletion of a user's account. This is, for example, true for matching questions, submitted using the "Suggest Question" feature, but not for, for instance, a user's name, "About" or other strictly personal data.

Warranty

§ The operator does not check the identity of users and is also not responsible for matches, contracts and agreements made on the platform. Thus, the operator assumes no responsibility for the set of users or information required.

§ In particular, the operator does not guarantee any of the following:

• The identities of users
• The accuracy and completeness of the work done by the users’ entries and declarations
• The behavior of users

§ In the published messages and profiles and their contents, is it only be carried out by external parties as defined in § 5 paragraph 2 Teleservices Act.

Changes

§ The operator reserves the right to change its site or its services, to add to or delete the publication and operation of the platform either temporarily or permanently at any time without prior notice and without giving reasons.

§ The operator also reserves the right to modify these terms at any time, without notice and without giving any reason to the users. Any changes made while a user is logged in will only take effect the next time the user logs in.

Liability

§ The operator is not liable for damages, tangible or intangible, to users or third parties arising from the use or non-use of youneaty. Similarly, the operator is not liable for damage or losses caused by a faulty or incomplete data transmission and data loss, especially when due to technical defects or when profiles are not represented fully. The operator is still not liable for the disclosure of information due to unauthorized access by third parties.

§ The operator is not liable for damages caused to users or third parties by the behavior of other users. The operator is not obliged to check whether any third party rights are affected by the provided user data.

§ The operator is liable only for damages based on intent or gross negligence by the operator or his legal representatives or employees. In the event of a breach of contract, the operator is not liable for indirect damages; the liability is limited to the typically foreseeable damages at contract conclusion.

§ youneaty may be temporarily unavailable or malfunctioning. The user may not make any claims against the operator for maintenance, congestion, system failures or software errors. The operator thus does not guarantee that a user dispatched message is delivered, correct or received by youneaty or is taken into account, or any other input from users is correct or complete or becoming part of the platform's database.

§ If the operator makes software available to the user, the operator assumes no responsibility for this.

§ The operator offers its users solely a platform for them to maintain their personal contacts.

§ The operator does not warrant, guarantee or take liability for offers or bids and the fulfillment of contracts.

§ The operator has no influence on the current and future design and content of the whipped through links on other sites on the Internet. Therefore, the operator hereby detaches himself in all forms from the publications of these sites, does not adopt their content and accepts no responsibility for it. This applies without exception to all direct and indirect links from the pages of youneaty which reach external sites or rather their content. Thus, only the provider of these sites is responsible for illegal, incorrect or incomplete contents and more so for damages resulting from the use or non-use of such content and not the operator. Once the operator is aware that there is a link from our page to a website with illegal content, the operator, after examining, will remove the link to this page.

Fees and Advertising

§ The creation of profiles and sending and receiving messages is free of charge for everyone. This is possible primarily through the marketing of advertising space on the pages of the platform e.g. the platforms dispatched e-mails.

§ It is prohibited for users to use content, which suppresses or change the display of the advertisements on the sites pages.

§ We use third-party advertising companies to serve ads when you visit our web site. These companies may use information (not including your name, address, e-mail address or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services which are of interest to you.

§ The operator reserves the right to charge a fee for specific or special services.

User Tracking

§ This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States . Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

§ We reserve the right to use other tracking tools without further notice.

General Rules

§ All legal relations between the operator and the user are subject to German law.

§ Jurisdiction for lawsuits against merchants, legal persons under public law or public law special fund is the responsibility of the owner.

§ Differing, conflicting or additional terms and conditions do not apply even when known, except when an application has been accepted in writing.

§ If any decisions provided on the terms and conditions of relevant laws no longer apply, the contents and validity of the remaining decisions will not be affected.
